User Agreement

Effective Date: 2021-01-01

This agreement is a legal contract between you and the Online Memorial Platform operator regarding the use of platform services. By registering, logging in, accessing, or using this platform, you acknowledge that you have read and agreed to be bound by this agreement and the Privacy Policy.

1. Service Content
1. The platform provides online memorial hall creation, worship interaction, message remembrance, genealogy-related services, and supporting value-added services.
2. The platform may adjust service content, functions, and rules according to laws, regulatory requirements, or operational needs, and will publish such updates on the platform.
3. Some services may be paid. Specific prices, rules, and rights shall be subject to the page display and order confirmation information.

2. Account and Security
1. You shall use true, lawful, and valid information to complete registration and properly keep your account and verification information safe.
2. Any loss caused by improper account management shall be borne by you. If any abnormality is discovered, you shall notify the platform immediately.
3. You shall not rent, lend, transfer, or sell your account, nor bypass the platform's security measures in any way.

3. User Conduct
1. The content you publish or upload shall be lawful, true, and complete, and shall not infringe upon others' lawful rights and interests, including name rights, portrait rights, privacy rights, reputation rights, and copyrights.
2. It is strictly prohibited to publish illegal or non-compliant, insulting, defamatory, vulgar, violent, false marketing, malicious traffic diversion, infringing, or pirated content.
3. It is strictly prohibited to use the platform for crawler scraping, API abuse, bulk registration, fake traffic, cheating, attacks, or sabotage.
4. You undertake that you have lawful authorization for the content you publish. If your content causes disputes, claims, penalties, or losses, you shall bear responsibility independently and compensate the platform for any losses.

4. Orders and Payment
1. By placing an order on the platform, you confirm the order information and agree to pay the relevant fees according to the published rules.
2. Services involving payment channels are handled by third-party payment institutions under their own rules. The platform shall not be liable for failures of third-party payment systems.
3. Unless otherwise required by laws and regulations or expressly stated by the platform, consumed digital services generally do not support no-reason refunds.

5. Intellectual Property and Authorization
1. The intellectual property rights of the platform software, page design, data structure, trademark logos, and related content belong to the platform or the relevant rights holders.
2. To the extent permitted by law, you grant the platform the necessary authorization to store, display, disseminate, back up, and conduct security reviews of your content for the purpose of providing services.
3. Without the platform's written permission, no entity may copy, scrape, reverse engineer, mirror, or otherwise illegally use the platform's content or technology.

6. Limitation of Liability and Disclaimer
1. The platform will make reasonable commercial efforts to ensure service continuity and security, but does not guarantee that the service will be absolutely uninterrupted, error-free, or defect-free.
2. To the extent permitted by law, the platform shall not be liable for service interruptions or losses caused by force majeure, network failures, abnormal third-party services, regulatory policy changes, hacker attacks, or other factors beyond the platform's control.
3. For disputes between users, third-party infringement, or claims, the platform may take necessary measures according to the rules and shall not bear liability beyond statutory obligations.

7. Breach Handling
1. If you violate laws and regulations, this agreement, or platform rules, the platform has the right to take measures such as deleting content, restricting functions, suspending services, banning accounts, or terminating services.
2. If your breach causes any loss, administrative penalty, or third-party claim against the platform, you shall bear full compensation liability.

8. Governing Law and Dispute Resolution
1. The conclusion, effectiveness, performance, interpretation, and dispute resolution of this agreement shall be governed by the laws of the People's Republic of China, excluding conflict-of-law rules.
2. Any dispute arising from or related to this agreement shall first be resolved through friendly consultation. If consultation fails, either party may file a lawsuit with a competent people's court in the location of the platform operator.
